A judge absolved the first man to have been arrested for speeding after the reforms to the Penal Code came into force, on the grounds that there was no evidence that the speed camera used by the Guardia Civil was working properly. The 39-year-old man from Dos Hermanos, Sevilla province, was caught on January 15th when speeding at 186 kph along a stretch of the A-4 Madrid-Cadiz highway with a speed limit of 100 kph. The judge said the prosecution had been unable to prove he was over the 180 kph limit which marks the difference between a crime and a simple administrative error. If he had been found guilty, under the new Penal Code the man would have faced three months in jail and the loss of his licence for one year and a day.
